Terms of Service
Effective October 23, 2026
These terms are an agreement between you and Kalimi LLC, a Wyoming limited liability company at 30 N Gould St Ste R, Sheridan, WY 82801, USA, which operates CherryMail. By creating an account you accept them.
1. The service
CherryMail provides email hosting, including webmail, IMAP, POP3 and SMTP access, custom domain support and a free @cherrymail.net address. Plans are limited by total storage. Mailboxes, aliases and domains are unlimited, subject to the Acceptable Use Policy.
2. Accounts
You must be at least 16 and provide accurate information. You're responsible for activity in your account and for the mailboxes you create for others.
3. Billing and renewal
Paid plans are billed in advance monthly, or for 1, 2 or 3 years, and renew automatically for the same term unless cancelled before the renewal date. Multi-year terms are discounted 10% (2 years) or 20% (3 years) against the yearly price. Prices exclude applicable taxes.
4. Refunds
Your first yearly or multi-year purchase is covered by a 30-day money-back guarantee. Monthly plans can be cancelled anytime and are not refunded for the current month. After 30 days, payments are non-refundable except where required by law.
5. Plan changes and storage limits
Upgrades take effect immediately, charged pro rata for the remaining term. Downgrades take effect at renewal if your stored data fits the new plan. When you exceed your storage, a 10% grace buffer applies; beyond it, incoming mail may be rejected until you free space or upgrade.
6. Free plan
Free accounts that are not logged into for 12 months may be suspended after two email notices sent 30 days apart, and deleted 30 days after suspension.
7. Your content
You own your email and data. You grant us only the rights needed to store, transmit and back it up to provide the service.
8. Suspension and termination
You can cancel at any time. We may suspend or terminate accounts that violate these terms or the Acceptable Use Policy, or that are unpaid after notice. Where possible, we'll give you a chance to export your data.
9. Availability and liability
We work to keep CherryMail available but provide it “as is” without guaranteed uptime unless agreed in an Enterprise contract. To the extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages.
10. Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Consumers keep any mandatory protections of their country of residence.
